- Section 12(1)(c) of the Right of Children to Free and Compulsory Education Act, 2009 mandates unaided private schools to reserve 25% of their entry-level seats for the children belonging to the economically weaker section and disadvantaged groups.
Defining children belonging to disadvantaged group and the children belonging to weaker section
1. Children belonging to disadvantaged group are:-
a. Orphan
b. The scheduled Tribe Communities
c. The Scheduled Caste Communities
d. Children with disabilities/Special needs (CWSN) as per the Section 2 (zc) and The Schedule of the Rights of Persons with Disabilities (RPwD) Act, 2016
e. Children suffering from HIV/AIDS
f. Children eligible for sponsorship under Section 45 of the Juvenile Justice Act, 2015
g. Children of Martyred Soldiers/ Central Armed Police Forces (CAPFs) or those killed in line of duty
h. Children of deprived Communities such as Tea Garden/ Migrant Workers
2. Children belonging to disadvantaged group are:-
a. Antodaya, BPL and Adhoc BPL families of OBC Communities
b. Antodaya, BPL and Adhoc BPL families of Religious Minority Communities
c. Antodaya, BPL and Adhoc families of UR Communities
d. If a child is studying in private school under non DG/EWS category and due to death of father/mother/guardian, who is the earning member of the family, the child under the EWS category.
